In cases involving missing or unknown heirs, personal representatives or their counsel are required to exercise due diligence in the investigation made to find such heirs or beneficiaries. Qualified genealogists have been approved and given preference by courts to assist personal representatives and their counsel to meet this obligation. It is an improper conflict of interest for an heir finder to charge a contingent or percentage fee. We always charge on a reasonable hourly rate plus costs basis, never on a contingent fee basis. Our forensic practice is currently limited to estates and trusts, and real estate, unknown heir matters arising in the United States; and other forensic genealogy matters (i.e., relating to the law).
